Biography

Joshua Upin maintains a national litigation practice rooted in complex business disputes and regulatory investigation response. He has served as lead trial counsel in numerous jury and non-jury cases in both state and federal courts; successfully guiding individual and institutional clients through litigation involving significant financial exposure. 

Joshua also leads the firm's E-Discovery efforts, managing advanced digital forensics and the efficient negotiation of mass volumes of multimodal data. He leverages leading-edge, AI‑driven litigation technologies to accelerate review and analysis of hyper-massed data sets, which enable his clients to reduce cost, while rapidly identifying both key risks and strategic opportunities that present within the litigation lifecycle.

Joshua’s work spans a broad range of industries, including insurance, energy, media & entertainment, financial services, construction, real estate development, food & beverage, healthcare, life sciences, and software development.

Beyond litigation, Joshua has experience advising clients on real estate financings, land use, corporate governance, and intellectual property rights. His transactional background includes experience with multimillion‑dollar corporate acquisitions and real estate development projects.

LITIGATION
  • Managed forensic collection and review of over 5 million electronic records on behalf of 168 affiliated client entities situated across more than 30 countries, responding to a subpoena issued incident to the Purdue Pharmaceuticals Bankruptcy.
  • Led forensic collection and agentic AI-driven review of 1 million+ electronic records in a federal case involving an international airport terminal expansion.
  • Represented one of the world’s largest electrical components manufacturers and electrical contractors in 14 associated construction contract default cases against the developer of a $400 million life sciences campus.
  • Led forensic collection and agentic AI-driven review of 300K+ electronic documents in a multi-million-dollar real estate dispute in state court, on behalf of a North Atlantic real estate development company.
  • Overcame Fair Debt Collection Practices Act claims in a federal jury trial for a Kansas-based debt collection agency.
  • Represented a mobile advertising company in a TCPA class action defense.
  • Represented multi-location owner/franchisee of national automotive service centers in a TCPA class action defense.
  • Obtained a declaratory judgment against the clients’ condominium association after a two‑day bench trial, successfully resolving issues impacting the building’s inclusion on the National Register of Historic Places in the client’s favor.
